Certified Electronic Mail (PEC) is an electronic mail system in which the sender is provided with electronic documentation, with legal value, certifying the sending and delivery of electronic documents.
“Certifying” the sending and receiving, the two fundamental moments in the transmission of electronic documents, means providing the sender, from their mail provider, with a receipt that constitutes legal proof of the sending of the message and any attached documentation. Similarly, when the message reaches the recipient, the provider sends the sender a receipt of successful (or failed) delivery with a precise time indication.
The introduction of Certified Electronic Mail (PEC) into Italian law has made available to private individuals, companies, professionals and Public Administrations an effective, economical and secure tool that guarantees Internet communications the same legal value as registered letters with acknowledgement of receipt.
The Digital Administration Code (Legislative Decree No. 82 of 7 March 2005) has given certified mail a value never before attributed to Web communications, making the receipt of messages enforceable against third parties in the event of a dispute. In particular, the Code (art. 48 paragraph 1) establishes that “The electronic transmission of communications that require a receipt of sending and a receipt of delivery takes place via Certified Electronic Mail pursuant to the Presidential Decree of 11 February 2005, no. 68”.
